The figures it uses have been taken from the fixed tariff within the Criminal Injuries Compensation Scheme 2012. The CICA use this Scheme to assess the eligibility of claims made through them and to value injuries.

This is a guide only. CICA decides final awards.

You can claim for up to 3 injuries under this tariff. So, if you have suffered multiple physical injuries, then the multiple injuries formula will apply:

  • 100% of the fixed tariff amount will be awarded for the highest-valued injury. 
  • 30% of the fixed tariff amount will be awarded for the 2nd most valued injury. 
  • 15% of the fixed tariff amount will be awarded for the 3rd most valued injury.  

It’s also important to note that if you are/were pregnant, lost a foetus, or contracted an STD as a result of the domestic violence, then compensation can be awarded that’s not subject to this multiple injuries formula.

Can I Claim For Loss Of Earnings?

Additionally, you could claim for loss of earnings through the CICA if certain eligibility criteria are met. 

This can cover future loss of earnings if you’re unable to return to work at all or for a long period of time.

Special Expenses For Domestic Abuse Compensation

Special expenses for domestic abuse compensation cover certain financial losses you have suffered as a result of domestic abuse. 

All of these financial losses must be necessary, reasonable, not available for free elsewhere, and directly resulting from your domestic abuse injuries.

Here are the types of special expenses that can be reimbursed:

  • Treatment costs that are not available for free under the NHS. This includes therapy costs. 
  • The costs of care relating to your bodily functions and/or food preparation. 
  • Supervision costs are incurred if this is needed to prevent substantial danger to yourself or others. 
  • Costs for specialist equipment that you need to cope with your injuries, such as a specially adapted car or kitchen equipment.
  • Costs to replace any property or equipment that you relied on as a physical aid that was damaged during the abuse, such as glasses or a hearing aid that was broken. 
  • Any adaptations made to your home, such as adding a stairlift and ramps. 
  • Costs for managing your admin affairs if you are unable to do so yourself due to a lack of full mental capacity.

What Time Limits Apply To Domestic Abuse Compensation Claims?

There is generally a 2 year time limit that applies to domestic abuse compensation claims made via the CICA. This time limit runs from the date the incident last took place. 

If you can prove that exceptional circumstances prevented you from making a domestic abuse claim within this time limit, then exceptions to this time limit can possibly be made. 

If you were under the age of 18 when the domestic abuse took place, here is how the claims time limit is affected:

  • If the incident has been reported to the police (but no claim was made on your behalf), the 2-year claims time limit commences from your 18th birthday, unless there are exceptional circumstances. 
  • If the incident has not been reported to the police prior to your 18th birthday, the 2-year claims time limit will commence from the date you report it to the police. However, you have to prove that exceptional circumstances stopped you from making a police report sooner.

Will I Need To Take My Abuser To Court To Claim Compensation?

No, you won’t necessarily need to take your abuser to court in order to claim compensation. Most CICA claims are settled without the need for court proceedings, as any funds awarded by the CICA come from them and not the perpetrator. You will, prior to claiming through the CICA, need to demonstrate that the perpetrator does not have the funds to compensate you themselves, and that is why you are claiming through the CICA. 

Additionally, the perpetrator does not need to have been convicted to be able to claim, but you will need to show the CICA that you worked with the police to help with this conviction.
