What Is After The Event Insurance (ATE)?
After The Event insurance, often abbreviated to ATE and sometimes referred to as litigation insurance, is a type of insurance that covers legal costs if your claim is unsuccessful. Taking out ATE insurance is extremely beneficial, no matter what kind of claim you are planning to make. It can be used for personal injury claims and medical negligence claims.
If your claim is unsuccessful, meaning you will not receive compensation, you may be required to pay other fees like your opponent’s legal costs. By purchasing After The Event insurance, you won’t have to worry about these costs or how you are going to pay them if your claim fails.

Who Will Need To Purchase ATE?
The solicitor in charge of your case will purchase ATE (After The Event insurance) on your behalf if your claim is accepted. All details of your ATE insurance policy will be discussed with you beforehand.
Purchasing ATE insurance is useful for all claims, as it means you will not be liable for the other side’s costs even if your claim is unsuccessful. This removes the financial risk from pursuing a claim.

Can ATE Be Used For All Types Of Claims?
Yes – as mentioned earlier, ATE insurance can be used for all kinds of compensation claims, including accidents at work and road traffic accident claims. You can find a more comprehensive list of claims that would have after the event insurance purchased for them here:
- Accident at work claims.
- Road traffic accident claims.
- Public liability claims (this refers to claiming compensation for accidents that happened in a public place).
- Medical negligence claims.
- Criminal injury claims.
- Housing disrepair claims.
There are additional types of claims for which you may be able to purchase ATE insurance. This is not an exhaustive list.
We understand that knowing the kinds of claims you can use ATE insurance for may appear confusing. It won’t cost you anything to speak to our advisors about purchasing insurance policies for various types of compensation claims.
What Is The Difference Between ATE And BTE
The main difference between After The Event insurance and Before The Event (BTE) insurance is timing. ATE insurance is taken out after an accident or incident has happened and a claim is being pursued, whereas BTE insurance is purchased in anticipation of and prior to any legal action.
If taken out in advance, BTE insurance (also sometimes referred to as legal expenses insurance) can cover certain legal fees. The fees covered will depend on the details of the insurance policy. This differs from ATE insurance, which should be taken out when a claim is being pursued and is designed to cover your opponent’s legal costs if your claim fails.
Our advisors are happy to discuss BTE and ATE insurance policies in more detail.
Can ATE Be Used For A No Win No Fee Claim?
After The Event insurance can absolutely be used when making a No Win No Fee claim. The No Win No Fee agreement policy used by our panel of solicitors is called a Conditional Fee Agreement (CFA). Put simply, claiming via a CFA means:
- You do not pay solicitor’s fees if your claim fails – though please note you may owe other legal costs, which is why After the Event insurance is beneficial.
- You will pay a success fee to your solicitor only if you receive compensation. This fee will be taken from your compensation and the percentage is capped at a legal maximum of 25%.
Please don’t hesitate to reach out to learn more about using ATE insurance with a No Win No Fee agreement like a CFA.
